Understanding that litigation is costly and time-consuming and may damage an organization’s reputation, we proactively address issues and strategically counsels clients towards favorable resolution of real estate disputes. We regularly pursue opportunities to resolve matters in our clients’ best interests through effective use of early dispositive motions, and we have broad experience in domestic and international arbitrations, mediations, private facilitations, and other forms of alternative dispute resolution. But when informal resolution is not possible, our litigators aggressively represent clients in court to achieve the best possible outcomes consistent with their objectives and budget concerns. Condominium Litigation

Our real estate litigation team works with condominium and homeowners’ associations to protect their interests and resolve disputes. Clients rely on our thorough and responsive communication to help them assess solutions and understand the implications of their decisions. They appreciate our collaborative approach of developing and devising strategies for remedying issues, and they count on us to aggressively defend their rights and interests when necessary. Our work includes:

• Interpreting, enforcing, and modifying governing documents, such as condominium declarations and association by-laws.

• Enforcing developer obligations, negotiating contracts, and ensure contractor performance.

• Resolving contractor disputes involving a wide variety of claims.

• Initiating lawsuits on behalf of our association clients against unit owners and occupants to enforce rules and policies, resolve nuisances, and collect assessments and fines through eviction actions when required.
