In “Trump Sued Over ‘One Reg In, Two Out’ Executive Order,” published by the Society of Human Resource Management, Nashville Attorney Jeff Beemer discusses the executive order’s impact on the Equal Employment Opportunity Commission (“EEOC”).
The January 30th executive order directs federal agencies to repeal two federal regulations for every new rule they issue. Labor and employment attorneys are debating the commission’s January 10th proposed enforcement guidance on unlawful harassment. They agree that, whether the EEOC officially issues the guidance on unlawful harassment or not, the document is still a good tool for employers to use.
In all likelihood, the EEOC will issue its updated enforcement guidance without significant changes to the proposed guidance, said Mr. Beemer. “Now is the time for HR professionals to make sure that their anti-harassment policies and procedures are consistent with the proposed enforcement guidance,” he said.
