Kim G. Ferreira

A partner in the firm’s Toronto office, Kim Ferreira is an experienced litigator with a broad commercial, construction, and bankruptcy practice. He approaches each matter with a practical, business-focused mindset, focused on outcomes that align with his clients’ objectives.

Kim has worked on nationally recognized litigation and insolvency matters while managing his own files and developing hands-on advocacy experience. He has appeared before all levels of court in Ontario, as well as the Québec Superior Court and Court of Appeal.

Kim represents clients in complex commercial disputes, including claims involving breach of contract, statutory duties, negligence, and fraud. His clients range from large infrastructure and regulated entities to private companies, auto manufacturers, directors and officers, creditors, and debtor corporations. He also continues to build on his experience in proceedings under the Bankruptcy and Insolvency Act.

In addition, Kim has an expanding condominium law litigation practice, regularly advising condominium corporations, boards of directors, and property managers on issues arising under the Condominium Act, 1998.

Kim is known for quickly understanding his clients’ goals and tailoring his approach accordingly. While he is an experienced trial and appellate lawyer, he recognizes that not every dispute needs to be litigated to conclusion. He is a skilled negotiator who focuses on achieving efficient, practical resolutions whenever possible.

Kim frequently speaks at continuing education programs hosted by Osgoode Professional Development, the Law Society of Ontario, and the Peel Law Association.

Outside of his practice, Kim enjoys spending time with his family and dog, and remains a loyal (if occasionally frustrated) Toronto sports fan.

  • City of Mississauga v. PSCC No. 1136 et al, 2025 ONSC 4711 (CanLII), represented respondents in successfully defending a statutory injunction brought to restrain gatherings at Ridgeway Plaza.
  • Zurich Insurance Company Ltd. v. Aquino, 2025 ONSC 4123 (CanLII), represented the plaintiff in obtaining Judgment for more than $68,000,000.00 as against the defendant, guarantor.
  • In Ontario Securities Commission v. Tsatskin et al, 2024 ONSC 4720, obtained leave to issue a certificate of pending litigation against lands owned by the defendants.
  • Represented various condominium corporations in arbitrations and in urgent applications for injunctive relief against problematic unit owners.
  • In YRSCC No. 1253 v. McConnell et al., 2024 ONSC 484, secured a compliance order and an order directing the tenant to permanently vacate the building.
  • Acted for a large nuclear sector client in ongoing commercial arbitrations.
  • In Equibit Group Ltd. v. Sergei Sachkov et al, 2023 ONSC 5623, defeated a leave to appeal motion to the Divisional Court, upholding an order setting aside judgment against the defendant.
  • In Wayne Safety Inc. v. Gendelman et al., 2023 ONSC 3517, successfully varied Mareva and Anton Piller orders to permit payment of legal fees and return of passports, on liberty and freedom of movement grounds.
  • In Soares v. Soares, 2023 ONSC 5826, resisted an application seeking entitlement to all net sale proceeds from a jointly owned home.
  • Defended a multi-million-dollar breach of contract claim in the nuclear sector through expedited arbitration, defeating the claim and obtaining a substantial counterclaim award.
  • Acted in multiple arbitration mandates for clients in the construction and nuclear sectors.
  • In Paletta International Corp. v. Liberty Freezers London Ltd., 2022 CarswellOnt 870, acted on a leave to appeal application to the Supreme Court of Canada, which was dismissed.
  • In Paletta International Corp. v. Liberty Freezers London Ltd., 2021 ONCA 383, successfully appealed, overturning a $3 million damages award and $300,000 costs award and replacing it with a judgment awarding no damages or costs.
  • In Re Deyell, 2021 ONSC 5593, obtained an order for partition and sale of property and judgment for full repayment of debt and costs for a creditor.
  • In LPIC v. Fiore et al., 2021 ONSC 7860, acted through trial resulting in a finding of resulting trust and declarations regarding beneficial ownership of property, with orders for sale by the trustee in bankruptcy for the benefit of creditors.
  • In MTCC No. 1396 v. Lisa Arsenault, obtained a compliance order under s. 134 of the Condominium Act against an unruly unit owner.
  • Litigation counsel to a large Canadian nuclear corporation in ongoing litigation and arbitration matters.
  • Negotiated resolution of a $100 million construction dispute.
  • Acted for clients in defence of Mareva injunctions.
  • Represented officers and directors in proceedings brought by bankruptcy trustees.
  • Acted for property developers in construction and landlord-tenant disputes.
  • Served as independent supervising solicitor in the enforcement of Anton Piller orders.
  • Acted for applicants and respondents on leave to appeal motions to the Supreme Court of Canada.
  • Represented owners, general contractors, and sub-trades in construction lien actions.
  • Acted for individual defendants in claims brought by the Royal Bank of Canada and other financial institutions.
  • Represented financial institutions in bankruptcy proceedings and applications for relief under s. 38 of the Bankruptcy and Insolvency Act.
  • Acted in enforcement of settlement agreements and dismissal of underlying arbitration proceedings.
  • Represented General Motors LLC and General Motors of Canada in the bankruptcy of Bionx Canada Inc., obtaining orders facilitating recovery and removal of equipment.
  • Represented a cosmetics distributor in defence of a claim by an Israeli license holder and in subsequent arbitration.
  • In Zaidi v. Hussain, 2018 ONSC 642, successfully defended claims alleging an interest in land owned by the defendants.
  • Defended a motor vehicle manufacturer in a product liability/malfunction claim.
  • Acted for a municipality in recovering damages arising from street racing incidents.
  • Acted for a municipal mayor in a defamation action.
  • In Ferina Construction Limited v. Anna Labno et al., 2017 ONSC 6469, successfully appealed a Master’s order, with the Divisional Court overturning enforcement of a default judgment in light of a stay of proceedings.
Acted for various creditors in applications under s. 178(1)(d) of the Bankruptcy and Insolvency
