Victoria Buchinger (Member, Phoenix) was recently quoted in the Law360 article, “Consumer Protection Cases to Watch in 2019.”
Victoria commented on the effects of the U.S. Supreme Court’s 2016 Spokeo decision, holding that plaintiff’s must allege concrete harm to bring statutory claims, rather than relying on a technical violation.
“It’ll be interesting to see what the high court does because, the confines and the actual hard case, everyday implications of Spokeo and Article III standing issues aren’t yet resolved,” Victoria said. “Injury still has to be addressed on a case-by-case basis, and you’re not sure which way it’s going to go.”
