Patrick Potter and Ashley Jericho were recently quoted in Global Restructuring Review, “Hong Kong proceedings denied recognition in Texas over US property requirements and COMI issues,” discussing how a Texas bankruptcy judge denied U.S. recognition and enforcement of the liquidation of a Hong Kong ceramics group (and its prior owner). “[F]or all the ink spilled and litigation consumed, the Sui-Fung Group Liquidation would likely have been eligible for Chapter 15 had the parties effectively funded a retainer in the United States prior to filing the petition,” Patrick and Ashley are quoted as saying.
