Jennifer Ko Craft (Member, Las Vegas) and Hilary Williams (Associate, Las Vegas) recently co-authored an article for Law360.
“What to Expect From ‘Scandalous’ Trademark Case” discusses the Federal Circuit’s recent overturning of the Trademark Trial and Appeal Board’s decision to deny Brunetti trademark registration. On January 4, the Supreme Court granted a writ of certiorari to hear the case.
“We don’t have a crystal ball, but money is on Brunetti getting a registration. Not a hard bet to make, when the Supreme Court in Tam stated broadly that, ‘speech may not be banned on the ground that it expresses ideas that offend’,” they wrote.
