Mark C. Walker (Member, El Paso) was recently quoted by Law.com for an article titled, “Bill to Limit Attorneys' Ability to Win Anti-SLAPP Dismissals Just Passed Texas House.” The original law, called the Texas Citizens Participation Act and passed in 2011, gave attorneys the ability to win dismissal of a wide range of case types, then collect attorney fees, using a motion to dismiss under the act.
“If you can get a case dismissed and get a reward of fees, then by all means, for your client, you want to try to do that,” Mark explained. Adding that if HB 2730 passes, it means lawyers will have to proceed with discovery and arguing the merits of their cases, which he favors.
