Mark Walker (Member, El Paso) was recently quoted in the Law360 article, “Texas Cases to Watch in 2019.”
Mark commented on Texas’ anti-SLAPP law, the Texas Citizens Participation Act, and its evolution. “Observers can expect legislation introduced this session aimed at limiting the scope of law. It’s the mandatory fees, that’s the driver,” Mark said, noting the increasing number of cases working through the courts (40 in 2018). “If you think you can defeat your opponent and make your opponent pay your fees, then there’s every incentive to make that claim, and at the same time there’s virtually no risk of having to pay your opponents’ fees.”
