Jacob Frenkel (Member, Washington DC) was recently quoted in the Law360 article, “Top New York Cases to Watch in 2019.”
Jacob commented on violations of the federal honest service wire fraud statute involving college basketball. “Many viewed as dead the statute – historically used successfully to prosecute municipal, local, county and state officials for corrupt activities – after the Supreme Court curtailed its misuse,” Jacob said, referring to a line of cases including Skilling v. USA in 2001. “This is a ‘heartland’ honest services fraud prosecution: a public university official, here a basketball coach at a public college, alleged to have participated in corrupt activity for personal benefit.”
