Lawyer Jacob Frenkel Comments on New SEC Chair Nominee

Attorney Jacob Frenkel, chair of the firm’s Government Investigations and SEC Enforcement Practice, recently spoke to the media about Jay Clayton, who has been nominated to chair the U.S. Securities and Exchange Commission. Mr. Frenkel spoke to Law360 and the Irish Times about the nomination.
He told Law360 that the agency in recent years has moved away from protecting investors and fostering capital formation. Clayton’s nomination could be a way to correct the SEC’s “misplaced obsession and focus on enforcement,” Frenkel said.
In the Irish Times, Mr. Frenkel said “The decision to choose a non-enforcement-centric person is the best possible decision for the capital markets. Nothing in the agency’s legislative history identifies it as a law-enforcement agency. It is a civil regulator with its mission expressly including capital formation.”
