Eric Gregory has recently authored an article for Law360, "An Informed Guide To Mastering Retirement Plan Forfeitures." In his article, he discusses what plan sponsors should consider in both the proposed IRS guidance and the allegations in the cases when examining practices for using plan forfeitures. ”Given that there is long-standing, explicit guidance from the IRS permitting the use of forfeitures to pay for administrative expenses, and the commonality of that practice, it would be a sea change for a court to hold that it constituted a prohibited transaction under ERISA,” said Eric.
