Jennifer Ko Craft was recently quoted in the Law360 article, "TTAB Decision Offers Rare Guidance On Insignia Denials." The article discusses the recent Trademark Trial and Appeal Board (TTAB)'s precedential ruling that the local government in Orange County, California, can't secure registration on an "unofficial" seal to market park services. In its rejection of the county's arguments, TTAB stated that whether the county has adopted a charter and the timing of any adoption, and whether it was incorporated, were "irrelevant" for purposes of trademark law, that it was technically not a "state or municipality" because it wasn't incorporated for self-government under California state law. "In other words, the government's determination of what is a seal and what is a municipality for its purposes is separate from the USPTO's determination of the same.
