Recently a Canadian Court was asked for the first time to consider whether the sale of a license independently owned from an operating business trips the prohibitions in the Real Estate and Business Brokers Act (REBBA). The Court founded in favor of Dickinson Wright’s client, stating that a license falls outside the definition of real estate in REBBA.
