Tenesa S. Powell

Of Counsel

Tenesa S. Powell is Of Counsel in the Dickinson Wright Las Vegas office.  Tenesa handles trademark and copyright enforcement, with an emphasis in Internet-related infringement.  Tenesa litigates in federal and state court, and before the Trademark Trial and Appeal Board.  In addition to her intellectual property practice, Tenesa handles commercial disputes, including business and contractual disputes, and business torts.

Prior to joining Dickinson Wright, Tenesa was a partner at an AmLaw 100 firm representing financial institutions and mortgage servicers in state and federal court primarily related to non-judicial, judicial foreclosures, Fair Credit Reporting Act, Fair Debt Collections Practices Act, title issues, bankruptcy, and HOA-related issues. Tenesa has tried nearly a dozen trials and has conducted well over 200 depositions.  After law school, Tenesa served as a judicial law clerk to the Hon. Elissa Cadish.

Prominent Assignments

Represented a non-profit corporation to challenge administrative regulations pertaining to Arizona’s Adult Use Marijuana Social Equity Ownership Program.

Worked on behalf of an airplane hangar operator to avoid eviction based on a wrongful refusal of option to extend 20-year lease agreement.

Recovered infringing domain names which were associated with counterfeit websites for a Fortune 500 company, a world-renowned sports exhibitor, and a highly regulated financial services company.

Successfully litigated matters for high-profile clients in front of the Trademark Trial and Appeal Board (TTAB), resulting in blocking registrations, canceling registration, and allowing clients’ marks for trademark registration.

Favorably negotiated resolution to a multi-million dollar trade secrets matter for a building supply company.

Prosecuted a defamation case by a personal products company against a competitor, resulting in removal of defamatory content and stipulation to refrain from further comments.

Defended a deceptive trade practices claim on behalf of an interior designer, resulting in its dismissal at summary judgment.  Dismissal also resulted in settlement of remaining claims.

Litigated infringement cases, both offensively and defensively, on behalf of a variety of clients.

Achieved removal of infringing content on behalf of numerous clients through cease and desist letters, DMCA take-downs, and service-based infringement complaints.

Resolved a copyright infringement claim against a high-profile client for a nominal figure.

Assisted in the defense and prosecution of patent infringement claims for various clients.
