Ted A. Kalnins


Ted Kalnins has a broad commercial litigation practice which includes breach of contract disputes, entertainment and sports litigation, franchise disputes, intellectual property disputes, employment law disputes, product liability claims, shareholder disputes, real estate disputes, and debt collection. His employment law practice includes litigation concerning wrongful dismissal claims, human rights violations, and breaches of non-solicitation, non-competition and confidentiality agreements. Ted has also prosecuted and defended claims of professional negligence against accountants, financial advisors, lawyers, and medical professionals.

During his career, Ted has accrued litigation experience in Ontario’s Superior Court of Justice, Divisional Court, Court of Appeal, the Federal Court of Canada, and various administrative boards and tribunals.

Prominent Assignments

Acted for both franchisors and franchisees in numerous court actions, including claims for rescission and damages pursuant to Ontario's Arthur Wishart Act

Successfully defended claim against manufacturer for breach of warranty and negligence

Obtained a Judgment for an injured worker against her union for breaching its duty of fair representation pursuant to section 37 of the Canada Labour Code

Obtained settlement on behalf of a widow against an insurer who refused to honour an accidental death policy

Successfully argued interlocutory motion to reclaim control over a website on behalf of a web based company

Successfully argued appeal to have claim dismissed against a manufacturer due to expiry of limitation period

Obtained settlements in relation to numerous wrongful dismissal claims

Obtained a Judgment in favour of former members of a church against the pastor for breach of trust
