Robert A. Shull has more than 35 years of experience litigating complex commercial and construction cases, representing both plaintiffs and defendants in state, federal, and bankruptcy courts. His practice includes commercial and real estate disputes, construction claims, fraud litigation, and bankruptcy litigation and other proceedings. In civil matters, Mr. Shull has represented clients in multimillion-dollar breach of contract, securities fraud, and “bet the company” litigation. His construction litigation includes representing owners, contractors, subcontractors, suppliers, and design professionals. In the bankruptcy arena, Mr. Shull has litigated major fraud and discharge cases, represented creditors and creditors' committees, and litigated complex, multimillion-dollar adversary claims.

Prominent Assignments

  • Successfully represented an unpaid partner in bringing a lawsuit stemming from a partnership to develop and sell an apartment complex. Prevailed at trial and obtained the fifth-largest civil jury verdict of 2019 in Arizona.
  • Represented prominent business owners in related complex commercial litigation actions (including one where claimed damages exceeded $27 million), bankruptcy adversary actions, and appeals. Prevailed in one action that was affirmed by the Second Circuit Court of Appeals.
  • Represented an environmental services business — the holder of the U.S. Forest Service’s largest-ever stewardship contract — in general corporate matters and several disputes. One dispute involved the successful defense of a $3 million claim for breach of contract.
  • Successfully represented a commercial landlord in suing a university for breach of lease after the university vacated the premises and ceased paying rent. Prevailed on dispositive motions and at trial. Affirmed on appeal.
  • Successfully represented Arizona commercial developer in a dispute relating to a ground lease between the developer and members of a Native American community. The case was resolved with the ground lessor’s waiving a $50 million lease claim and agreeing to a ground lease restructuring.
  • Represented then-Arizona governer J. Fife Symington, III in prominent Chapter 7 bankruptcy filing and related matters.
