Matthew Martinez’s practice focuses on representing employers in all matters of business immigration. He represents companies from a broad spectrum of industries including major healthcare providers, multinational corporations, government agencies, sports franchises, professional athletes in the MLB and NHL, and performers in the entertainment industry. Matthew is fluent in Spanish and advises Latin American companies from across the globe in setting up operations in the U.S. and transferring key employees. He counsels companies on complex immigration issues that arise in mergers, acquisitions and reorganizations, and assists companies with I-9 and E-Verify issues, including internal audits and government investigations.

Matthew represents companies in the preparation of nonimmigrant visa petitions, labor certification (PERM) applications, immigrant petitions, and permanent residency applications. He regularly works with companies to conduct internal I-9 audits in an effort to assess compliance with immigration, employment and discrimination laws, and works with clients to develop hiring policies and procedures. Matthew also assists employers in responding to agency-initiated workplace audits and investigations.

Matthew works closely with companies from diverse industries, including the resort, equine and agricultural industries, to develop guest worker programs that provide temporary and seasonal workers. In addition, he has extensive experience representing professional athletes, particularly in the baseball and equestrian industries. Matthew also assists companies in sending employees abroad, working with HR professionals and individual employees to obtain appropriate outbound visas.

Matthew is an active member of the American Immigration Lawyers Association and frequent speaker on immigration matters affecting employers, and he also lectures international students at major universities regarding their post-graduation employment options.

Provides counsel to companies navigating the H-1B application process, including preparing for the H-1B lottery and extensions of F-1/OPT for STEM graduates.

Represents investors applying for E-2 treaty investor and E-1 treaty trader visas at various U.S. consulates throughout the world.

Handles PERM labor certification applications, J-1 Conrad Waiver applications, National Interest Waiver applications, and Schedule A petitions.

Assists clients with EB-1, EB-2 and EB-3 permanent residence petitions.
