Mr. Dodson advises general contractors, owners, and manufacturers in all stages of the construction process. He has addressed large design and construction defect claims, payment claims, bid protests and numerous other disputes arising in the commercial construction process. Mr. Dodson has prepared construction agreements for a number of his clients to protect against the risks of commercial construction. His clients have experienced fewer disputes as a result of the clarity of the contractual obligations of the parties.
Mr. Dodson has particularly deep experience with construction in the healthcare industry, having represented facility owners in a broad range of construction issues which are further complicated by the regulatory requirements imposed upon healthcare facilities.
Mr. Dodson has also represented numerous clients in the energy industry in construction, environmental and regulatory issues. From oilfield pollution claims in Louisiana to windfarm develop in the Mid-West, he has deep experience in the industry.

Negotiated closeout disputes for the owner on a $40 million healthcare project in Pennsylvania. The disputes involved electrical engineering and installation issues among others. The disputes were resolved favorably for the client without having to engage in litigation.
Litigated a $12 million construction defect claim for the owner of a hospital in Tulsa, Oklahoma. The claims involved defects in the building envelope which caused major moisture intrusion issues. The claim was settled favorably for the client.
Represented a dredging contractor in a bid protest in South Louisiana.
Represented a tire manufacturer in claims brought by over 100 adjoining property owners seeking in excess of $50 million in damages for air and groundwater pollution. The groundwater pollution claims resulted from an underground leak of naptha which is used in the tire manufacturing process, and the air pollution claims related to the airborn trespass of carbon black particles which migrated to the adjacent properties. After completing discovery and beginning the first day of trial, the claims of all plaintiffs were settled on very favorable terms for our client.
Represented a refractory subcontractor in an $8 million payment dispute with the general contractor of a circulating fluidized bed, lignite coal power plant in Mississippi. After a one week trial, the jury returned a verdict in favor of the client for the full amount of its damages.
Represented the manufacturer and constructor of a large recovery boiler in claims relating to the explosion of the boiler at a paper mill which resulted in numerous fatalies. Our early, aggressive investigation and response to the claims with documented evidence and expert opinions resulted in the abandonment of the claims against the firm’s client prior to litigation which was subsequently brought against other parties.
Represented oil and gas exploration and production companies in claims of groundwater pollution brought by landowners in Southeast Louisiana. The Plaintiffs sought in excess of $500 million in damages from over 50 defendants. Our aggressive litigation strategy resulted in the lowest settlement of any of the defendants in the case and very favorable terms for our clients.
Represented a manufacturer of modular housing in construction defect litigation. After a two week jury trial, the jury returned a verdict in favor of our client on all counts.
Represented a refractory subcontractor in litigation over payment for approximately $8 million of work on a power plant in Mississippi. After a week-long jury trial, the jury returned a verdict in favor of our client on all counts.
Represented one of the nation’s largest hospital companies on all construction related issues nationwide.

Represented a contractor specializing in convenience store construction and renovation on all construction issues nationwide.
Represented an international general contractor on disputes totaling $30 million regarding the construction of a large multi-family housing development.
Represented a regional general contractor on disputes arising from the renovation and addition to a historic building in Tennessee.
Represented a national general contractor on construction issues and disputes throughout the Southeast.
Represented the nation’s largest manufacturer of transformers in contract disputes in Alabama, Mississippi, Tennessee and Arizona.
Litigated a construction defect claim for the owner of a hospital in Tucson, Arizona. After a week-long jury trial, the jury returned a verdict in favor of our client and also awarded all attorneys’ fees incurred by the client in the litigation.
Litigated a construction defect dispute for a developer of a regional healthcare facility. The claims involved allegations of improper foundation work resulting in settling of the building.
Represented an insurance carrier to evaluate the claims in a multi-million dollar claim resulting from the failure and collapse of a thirty foot tall wall of a wastewater basin. The insurer sought an evaluation of the claims several months prior to a pending trial date. After providing the requested evaluation, the case was resolved favorably to the client.
Represented a financial institution in a month long jury trial alleging fraudulent lending practices of the bank in relation to a loan for the development of a subdivision. The case was resolved favorably for the client after the conclusion of the trial.
Represented a hospital owner in Georgia regarding the defective design and construction of the HVAC system.
Representation of the owner of multiple hospitals in Pennsylvania in litigation with a general contractor who constructed two facilities for our client. The claims are in excess of $8 million dollars and include allegations of kickbacks and fraud.

Representation of a national broadcasting company to prepare construction contracts for projects across the country as well as any construction disputes that arise.
