David Ouimette focuses his practice on Commercial & Business Litigation. Mr. Ouimette has over 35 years of experience in complex commercial litigation, including real estate, land use, securities, professional liability, business torts, property and casualty insurance, liability insurance, title insurance, and general corporate and business disputes. He also has experience in litigation of issues regarding public utilities, employment termination, lender liability, municipal law, administrative law, Indian law, taxation and commerce, and landlord-tenant disputes.

Prominent Assignments

Defended large Arizona municipality against claims that intersection design wrongfully diminished adjacent commercial property owner’s access rights, obtaining summary judgments at trial court level, and affirmances on appeal, in two related actions.

Defended law firm in decade-long, multi-million dollar malpractice dispute, eliminating multiple claims through pretrial motions, and balance of claims through complete vindication at trial.

Successfully defended property management company in dispute with liability insurer over insurance coverage for personal injury litigation alleging biological contamination at large condominium complex.

Obtained voluntary dismissal of malpractice action against lawyer defendants, who had handled large personal bankruptcy for former client, after aggressive discovery exposed fatal deficiencies in client’s claims of professional negligence.

Obtained voluntary dismissal, after motion practice and discovery, of legal malpractice claim arising out of commercial real estate transaction and allegations of lawyer conflict of interest.
