Phoenix Lawyer Timothy McCulloch was quoted in the Law 360 article titled ““Rare Southwest Engine Failure Prompts Liability Questions”.
In light of the first U.S. commercial airline fatality in nine years. The National Transportation Safety Board is investigating the cause of the engine explosion on Southwest Airlines Flight 1380 and industry observers are cautioning against a rush to over-regulate after this extremely rare occurrence.
McCulloch said that the incident was a "statistical anomaly" and that the FAA has done a good job of managing the national aviation system safely. "I'm sure the FAA is going to be subject to significant scrutiny depending on what comes out of this, and that's probably healthy," McCulloch said. "I hope it doesn't result in a situation where there is a change in the FAA's compliance philosophy toward again a very adversarial type of relationship."
