Employers: Are You Following = Michigan=E2=80=99s New=20 Mandatory Employee Safety Requirements?

continues to impose hardships on lives around the globe. Employers of =
American=20
workers have to adjust to constantly-evolving laws and regulations =
governing=20
their operations to keep their employees safe.
On Friday, April = 24,=20 Michigan=E2=80=99s Governor Whitmer issued an extension of her = =E2=80=9CStay Home, Stay Safe=20 Order,=E2=80=9D through May 15, 2020. Executive Order 2020-59 (COVID-19) contains new, = mandatory=20 requirements for employers who continue to operate in-person or who are = now=20 permitted to =E2=80=9Cresume=E2=80=9D in-person operations.
For = example, as of April 26,=20 2020 at midnight, employers must =E2=80=9Cprovide non-medical grade face = coverings to=20 their workers=E2=80=9D who perform in-person work. All Michiganders who = can =E2=80=9Cmedically=20 tolerate a face covering=E2=80=9D must wear a =E2=80=9Ccover over his or = her nose and mouth =E2=80=93=20 such as a homemade mask, scarf, bandana, or handkerchief=E2=80=94when in = any enclosed=20 public space.=E2=80=9D Persons wearing masks are protected from = discrimination on the=20 basis of their mask-wearing under Michigan=E2=80=99s anti-discrimination = laws.
In addition, Employers with in-person operations must have a written = =E2=80=9CCOVID-19=20 preparedness and response plan=E2=80=9D that is consistent with CDC and = OSHA safety=20 guidance. Employers must adopt cleaning and disinfecting protocols; = adopt=20 policies to prevent workers from entering the premises if they have = respiratory=20 symptoms or have had contact with a person who tested positive for = COVID-19;=20 follow all social distancing and mitigation measures recommended by the = CDC; and=20 provide other appropriate personal protective equipment. =
Employers=20 should honestly assess their employees=E2=80=99 risk of occupational = exposure to=20 COVID-19, their social distancing and safety measures, and guidance from = OSHA=20 and the CDC to update safety practices.
