It is no secret the Covid-19 pandemic has caused an unprecedented economic crisis throughout the US.

Throughout the pandemic, the US unemployment rates spiked, which hindered millions of tenants and homeowners from meeting their lending and lease obligations. In September 2020, the Center for Disease Control (the CDC) issued a federal eviction moratorium, providing relief to tens of millions of renters at risk of eviction for nonpayment of rent during the global pandemic.

However, as the temporary moratorium will soon expire on 31 March 2021, and evictions and foreclosures are slowly being phased back into effect, property owners will likely resume evictions and foreclosure proceedings.

As landowners contemplate how to proceed with tenants who are past due on their rent or mortgage, they should not overlook potential intellectual property liability.
