Overview

Kerry has deep experience in leading legal teams tasked with solving complex problems. As U. S. Attorney for the Eastern District of Kentucky, Kerry placed special emphasis on financial fraud, healthcare fraud, and public corruption. Under his leadership his office made record False Claims Act recoveries and prosecuted groundbreaking healthcare fraud cases. He served for three years on the Attorney General’s Advisory Committee and served as Co-Chair of the U.S. Attorney’s Healthcare Fraud Working Group. Kerry served the Commonwealth of Kentucky as General Counsel of its Cabinet for Health and Family Services and Acting Inspector General. As the Commonwealth’s top healthcare lawyer, he represented Kentucky in reimbursement methodology litigation, certificate of need matters, and licensing issues.

Kerry’s private practice experience includes representation of healthcare providers, financial institutions and public officials. He served on the Board of Director’s of Kentucky’s largest owner/operator of hospitals, as well as publicly traded financial institutions. In addition to extensive litigation experience, Kerry advised a number of businesses as outside general counsel concerning compliance, governance, and regulatory issues.

Negotiated innovative $195 million settlement of Medicaid Rate Appeals filed by more than sixty Kentucky hospitals

Represented Commonwealth of Kentucky in CRIPA litigation directed at state owned facilities

One of the leaders of team that earned CMS recertification of state owned ICF/MR facility

Appointed by Attorney General Eric Holder to Attorney General’s Advisory Committee

Served on National Heroin Task Force

Co-Chair, United States Attorneys’ Healthcare Fraud Working Group

Led efforts resulting in record False Claims Act recoveries in the Eastern District of Kentucky
