Attorneys Scott Petz & Salina Hamilton Published Adverse Inference Article in MDTC Quarterly

Dickinson Wright Attorneys Scott A. Petz and Salina M. Hamilton have written an article that was recently published in the Michigan Defense Trial Counsel’s Michigan Defense Quarterly. The article, titled “Adverse Inference: The ‘Culpable Element’” examines Sekisui Am Corp v. Hart, in which the United States District Court for the Southern District of New York considered whether an adverse inference sanction is appropriate where a party intentionally, but not in bad faith, destroyed electronically-stored information kept by several key witnesses in the case.
