Labor News: Supreme Court Expands Employer Liability for Retaliation Claims

By Trent B. Collier On June 22, 2006, the United States Supreme Court issued a decision that expanded employer liability under Title VII. This decision, Burlington Northern and Santa Fe Railway Co. v. White, held that an employer may be liable for retaliating against an employee who complains of discrimination even if the employer's actions have no connection to the workplace. In addition, the Court held that a challenged action may constitute unlawful retaliation under Title VII if it would have deterred a reasonable employee from making or reporting a charge of discrimination. This ruling not only expanded employer liability under Title VII but may also have repercussions for other employment discrimination claims under federal or state law.
