Real Estate Workouts & Foreclosures

Dickinson Wright has extensive experience representing both borrowers and lenders, including financial institutions, life insurance companies, and other lenders, loan servicers and special servicers, and Fortune 500 companies, developers and private land-holders in workout, restructuring and foreclosure matters, including bankruptcy and litigation matters related to loan enforcement. Our practice regularly involves complex multi-state transactions, and includes specialty property types, such as hotels, entertainment and sports facilities, and healthcare properties.

Some of the areas of expertise within the real estate workouts, restructurings and foreclosure practice include:

  • Assisting with the modification, restructuring and workout of troubled loans, including negotiations related to recourse and non-recourse carveout guaranties.
  • Providing counsel for judicial and non-judicial foreclosures, including deeds-in-lieu of foreclosure.
