Lead trial counsel in jury and bench trials involving construction, workers’ compensation, commercial transactions and tort liability litigation in federal and state courts throughout Tennessee.
Experienced in representing trucking companies in personal injury, workers’ compensation and wrongful death litigation.
Successfully defended electrical cooperative in a personal injury jury trial involving 2 separate accidents with allegations of traumatic brain injury resulting in a favorable verdict for the client.
Extensive experience in construction litigation on behalf of general contractors and subcontractors.
Represent electric cooperatives throughout the State of Tennessee in a variety of litigation, including electrical contact and fire loss cases.
Experienced in representing manufacturers in products liability litigation, including mechanical equipment, food processing and consumer appliances.
Successfully defended general contractor in a residential home defect trial involving significant structural and cosmetic issues.
Successfully defended minority members of a Tennessee Limited Liability Company in actions involving allegations of fraud, breach of contract, banking policy violations and foreclosure.
Favorably resolved numerous disputed claims on behalf of prominent regional and national insurance companies.
Defended depositions and preformed research in aid of representation of nationwide class of lead and assistant managers, including ultimate success on issue of the opt-out provision of the American Arbitration Association's Class Arbitration Rules applying to arbitration proceeding and not the opt-in provision of the Fair Labor Standards Act normally applicable in court actions. Long John Silver's Restaurants, Inc., v. Cole, et. al., 514 F.3d 345 (4th Cir. 2008).
Extensive trial work representing insured litigants and insurance companies in workers’ compensation actions.
Multiple appearances before the Tennessee Supreme Court and Court of Appeals on various matters.
